Terms of Service

These terms are an agreement between you and Sjenkie B.V., trading as Yellow House Digital, a company registered in the Netherlands (Chamber of Commerce NL: 60310030) ("we", "us"), which runs ListSpace.app (the "service"). By creating an account or using the service, you accept them. If you do not accept them, do not use the service.

1. Who can use ListSpace

You must be at least 16 years old, or meet the minimum age in your country with the consent of a parent or guardian where the law requires it. If you use the service for an organization, you confirm that you may accept these terms on its behalf, and "you" also means that organization.

2. Your account

Give a real email address that you can receive mail at. Keep your password private: you are responsible for everything that happens under your account. Tell us at hello@listspace.app straight away if you think someone else has access to it. One account is for one person. Keep API tokens you create in Settings just as private: a token acts as you, and you are responsible for what the apps and AI assistants you give it to do with it. Revoke any token you no longer use or trust.

3. What you may use ListSpace for

You may use ListSpace for any lawful purpose, personal or for work, as long as you follow these terms. We give you a personal, non-exclusive, non-transferable right to use the service while your account is active. We keep all rights in the service itself, its software, design and name.

4. What you may not do

You may not use ListSpace to store, share or link to anything that is illegal, or to:

  • Share sexual content involving minors, content that promotes terrorism or violence, or any other content that is illegal where you or we are
  • Infringe anyone's copyright, trademark, privacy or other rights
  • Harass, threaten, defame or impersonate anyone
  • Upload malware or anything meant to harm devices, data or the service
  • Send spam or phishing, including through shared board links
  • Access other people's accounts or data, probe or break the service's security, or overload it
  • Copy, resell or rebuild the service, or scrape it with automated tools

5. Your content

Your boards, cards, comments and files stay yours. You give us only the rights we need to run the service for you: to store, copy, back up, process and show your content to you, and to the people you share a board with when you turn on a share link. These rights end when you delete the content or your account, except for copies in backups that are removed in the normal backup cycle.

You are responsible for your content and for having the right to upload it. Boards are private unless you share them. We do not read your boards, but we may look at content when it is reported to us, when we need to fix a problem you asked us about, or when the law requires it.

6. Reports and removal

Images that are publicly visible, such as board backgrounds and images you choose to show on a shared board, are automatically checked against known child sexual abuse material by our provider Cloudflare. A match is blocked and reported to us. Files on private boards are not scanned.

If you see content on ListSpace that breaks the law or these terms, for example on a shared board, report it to hello@listspace.app. We may remove content, turn off share links, suspend or close accounts, and pass information to the authorities when we are legally required to or believe in good faith that it is needed to prevent harm.

7. Ending your account

You can delete your account at any time in your settings. This permanently deletes your boards, lists, cards and uploaded files.

We may suspend or close your account, with or without notice, if you break these terms, if the law requires it, or if your use puts the service or other people at risk. When an account is closed, its content is deleted.

8. Changes to the service, fees and limits

ListSpace.app is currently free to use. We may, at any time and at our own discretion:

  • Change, suspend or discontinue the service, in whole or in part, including closing it permanently
  • Introduce fees or paid plans for the service or for some of its features
  • Set or change limits on use, such as the number of boards, cards or users, storage space, file sizes, or new sign-ups

Where reasonably possible, we will announce such changes in advance by email or in the app. You will never be charged unless you have explicitly agreed to a paid plan.

9. Keep your own copies

We work to keep your data safe, but we do not guarantee that content will never be lost, damaged or unavailable. Keep your own copy of anything important.

10. No warranty

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, availability, accuracy and non-infringement, to the fullest extent the law allows. We do not promise that the service will be uninterrupted, secure or free of errors.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, profit, revenue, business or goodwill, arising from your use of, or inability to use, the service, even if we were told such damage was possible.

Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars. Nothing in these terms limits liability that cannot be limited by law.

12. Your responsibility to us

If someone makes a claim against us because of your content or because you broke these terms or the law, you will cover our reasonable costs of that claim, including legal fees, to the extent the law allows.

13. Other services

The service relies on providers such as Supabase, Cloudflare and MXroute, and can load content from others, such as Pexels images and the YouTube tour video. We are not responsible for those services, or for websites that cards or boards link to.

14. Changes to these terms

We may update these terms. We will tell you about important changes by email or in the app before they take effect. If you keep using the service after that, you accept the new terms; if you do not accept them, delete your account.

15. Governing law and disputes

These terms are governed by the laws of the Netherlands. Disputes are handled by the competent court in the Netherlands. If you are a consumer living in the European Union, you keep the protection of the mandatory laws of your own country and may also bring a claim there.

16. General

These terms and the Privacy Policy are the whole agreement between you and us about the service. If a part of these terms cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up. You may not transfer your rights under these terms; we may transfer ours, for example if the service moves to another company.
